That did not mean that humans had freedom in an absolute subjective sense to determine how to effect these transitions. The institutions, roles and rules of modern law provided formal structures establishing who and how and when and in what form, these transitions were to be effected.
However, to say that the stages of modern legality were human mediated is to say that the key processing work of investigation, interpretation and decision was centred in the human, aided and abetted by the prosthetic paper memory of text and archive.
Figure 1 Schematic of Modern Legality However, digital legality as identified in Caprica challenges this schematic. Speed, autonomy and hybridity disturb these relationships and flows.
Instead of paper there is data. The archive has become dynamic and code can directly mediate the real. In Caprica what was manifest in the living avatars was a direct mediation of the archive with life without the human and textual 94 Peter Goodrich, Languages of Law: From Logics of Memory to Nomadic Masks Weidenfeld and Nicholson, Data and the virtual did not remain quarantined within the archive, but interfaced with the real directly.
The immediate envisioning of this in Caprica were the military robots that Graystone Industry developed that became infected with the personality constructs made by the avatar program to become the deadly Cylons of Battlestar Galactica. In the robot the autonomy and hybridity of the digital was represented.
The data crossed to the real and affected the real while retaining its virtuality. A less obvious representation was the absence of keyboards in the workplaces of Caprica. Graystone and his techs seemed to do their programming through graphic user interface GUI touchscreens; there were no representations of cutting code via alpha-numeric keystrokes.
The icons of GUI suggest a much more active archive that limits data input according to the binary of yes and no. Instead of the analogue of 96 text, GUI predetermines responses. The great archive interfaces directly with life; data is extracted by sensors and bots and data becomes real though robotic systems that directly control resources. This can be seen in figure 2. In losing the human, in becoming inhuman, and those established and known concepts of within modern legality of life, law, text and violence become atomised.
Without human sensing and processing the transitions between life, law, text and violence, digital legality seems rather alien. These would move in two directions; be filed into the archive and feed into the enforcement mechanism. The robotics of the camera sensors in the road, the camera, the write once, read many disk and the direct networking sees and reports at first instance the violation.
Data comprising the image of the vehicle, its velocity, the time and day is bundled together by the camera robot. The data is then transmitted to a central node. The registration details of that vehicle are then searched through the database of vehicle registrations to find the contact details for the owner of the vehicle and an automatically generated infringement notice is issued to the owner. Its speed is immediately obvious. Whereas in modern legality time was needed to generate text and move files; the process from recording a transgression to issuing of a notice with speed cameras can be almost instantaneous.
Paper has evaporated from the process, and humans have also vanished. Human involvement is limited to two possible sites. The enforcement mechanism could also be further automated. Allowing the speed camera system to interface with the banking and finance system could facilitate automatic fine payments. A speeding driver could pass a speed camera and be informed of a fine via a message to their smart device notifying them of the infringement and that the fine has been charged to their bank account.
Whereas Caprica presented digital legality in a dramatic fashion with living avatars operating between real and virtual worlds, speed camera systems present the mundane, already everyday-ness of digital legality. Speed cameras also show the inhumanity of digital legality — of how humans as the key mediators between life, law, text and violence — are becoming redundant.
It does not mean that life, law, text and violence have necessarily become redundant; rather their core meaning in modernity of law as human life being written about and interpreted by humans in text facilitating violence by humans against humans, seems to have dissipated. That touchstone of the human within each is changed. Programming of Digital Legality The issue for legal theory is what to make of this change in the materiality, and with that, the essential features of law?
There can be a utopian celebration of the digital turn. Positivism dreamed of the law machine. What is appreciated in this utopian assessment of digital legality is the reduction of legal transaction costs.
Code means that the archive becomes dynamic, generating its own data through sensors and bots and this data through autonomous robotic systems can effect change on life. The biopolitical machine can operate at greater efficiency. It will be quicker, there will be less compliance costs as the number and roll of subjective and expensive humans decrease and it will be more uniform in its outcomes.
Human life is extracted from and then managed, but does not have any participation in the processes. It showed a world and humanity in decline. They gave the impression of compliance while bidding their time for revolution. As observed, one of the disappointments of Caprica was that human were deprived of agency. For much post-positivist legal theory the issue has been how to reconnect the human to the legal system as a participant.
Flimsy, contested and imperfect, rights functioned liked pause moments in the operation of modern legality. Rights, when they worked, made the machinery of modern legality slow down, consider more widely or closed off particular ways for life and text to interface.
In digital legality, what was aimed for in modern legality through rights can only be expressed as code. Code is something that legal theory has yet to adequately theorise. Yet the basic feature of code is it is programmability. What pause moments do is that they allow digital legality to be more responsive to the life-world. As has been identified in the extreme manifestation of digital legality the inputs are solely generated by sensors and bots.
These take data from the life along predetermined paths. There is little hope in this vision — the techno- totality will paternalistically process human life without the textual and human centred decision making safeguards that ensured bios in a functional modern legal system. This vitalistic zoe surprises, always going beyond the known and expected.
What pause moments programmed into code can potentially allow is openness to the ever possibility of the surprisingness of zoe. The possibility of justice of modern legality ultimately was in the analogue potential that the human nodes of the legal system could appreciate unexpected difference and accordingly interpret and act differently.
Rights were the mechanism for that difference to be communicated. The analogue through rights kept an openness to zoe; it allowed the possibility for life to present itself as something unexpected and exceptional where the normal workings should be suspended and changed.
In digital legality, its tendency to totality means that this openness to zoe needs to be very clearly programmed into its code through pause moments.
The task for legal theory is the embedded, technical task of envisioning how to program the program to pause.
